Human Rights (HR) Violations in the CHT – 2001

These are some accounts of HR violations among thousands of unaccounted for against indigenous Jumma people by security forces and illegal state sponsored Bengali settlers

2 January 2001 : Innocent Jumma arrested by the police of Ramgarh police station

On 2/01/01 at 4.00 p.m. the police from Ramgarh police station arrested Mr. Aung Sui Ching Marma alias Anghla Mong (25) s/o late Chatari Master of village Dewan Para under Guimara police station in Khagrachari district while returning home from father-in-law's house of Garjantalib by bus. Next day, the police lodged a false case against him and sent him to the district court.

2 January 2001 : Innocent Jumma arrested by the police of Ramgarh police station

On 2/01/01 at 3.00 p.m. the police from Ramgarh upazila arrested an innocent Jumma named Mr. Biranga Chakma (31) s/o Jitendra Chakma of village Buddhadhan Karbari Para under Guimara police station in Khagrachari district from Jalia Para. He was sent to Khagrachari district jail.

2 January 2001 : PCJSS members were tried to arrest by the police of Guimara police station

On 2/01/01 at 10.00 p.m. the police of Guimara police station rounded up the houses of Mr. Binay Chakma, member of Guimara UP and member of PCJSS Guimara UP committee and Mr. Rangachoga Chakma (35) of Indramani Karbari Para under Guimara police station in Khagrachari district. At that time, Binay Chakma was not at home but the police harassed his wife. Rangachoga was at home but he could narrowly escape. The main cause of trying to arrest them by the police is to harass the PCJSS members.

3 January 2001 : Military operation in Ramgarh and Guimara

On 3/01/01 several groups of army from Patachara camp, Parshuramghat camp and Guimara brigade along with police conducted operation through out Ramgarh and Guimara areas relating to kidnapping incident of Dolphin bus driver on 2/01/01 from Ramgarh-Matiranga road. This operation had been continued for a week. Hundreds of army camped at Buddhadhan Karbari Para Primary School. They harassed the innocent Jumma people including women and children during the operation.

9 January 2001 : Innocent villager arrested and tortured by the army of Guimara brigade

9/01/01 at 5.00 a.m. a group of army from Guimara brigade conducted operation at Dhamai Para of Abya mouza under Guimara police station in Khagrachari district. In this operation, the army searched the house of following villagers and then arrested them. They were released later after phiscally torture. The victims were-

13 January 2001 : Innocent villagers arrested by the army of Barkalak Atiar camp

On 13/1/2001 camp commander of Barkalak Atiar army camp Subedar Ahmmad arrested the following inncent Jumma villagers from Barkalak village. They were falsely accused to keeping arms. They were handed over to the police of Barkal police station after brutally torture and then transferred to Rangamati jail. The victims were:

1) Mr. Meghanath Chakma s/o Rabi Chandra Chakma

2) Mr. Prabhat Chakma s/o Sahadev Chakma

That day at mid-noght, the camp commander beaten the following sick person at his home as he was working for PCJSS. The victim was:

1) Mr. Amal Krishna Chakma (24) s/o Jattanya Chakma.

23 February 2001 : Jumma woman raped by the BDR person of Dasharat Para camp

On 23/02/2001 Ms. Gurumila Chakma w/o Nandu Chakma of Chandabighat under Bhushanchara union of Barkal upazila in Rangamati district was reped by Shafi (writer) of Dasharat Para BDR camp under Barkal upazila while she was staying alone at her house. It was informed to camp commander Subedar Saidul Islam for action. But no action has been taken against it so far.

23 February 2001 : Innocent Jumma youths arrested by the army of Island camp

On 3/4/01 at mid-night a group of army of 14 EBR from Island camp under Kaptai brigade in Rangamati district conducted an operation at Raikhali, Narangiri, Panchari and Gangri areas under Kaptai upazila. In this operation, the following Jummas were arrested from their home by the army. The victims were:

(1) Mr. Uthowai Prue Marma, Chitmaram UP member and Organizing Secretary of JSS Kaptai upazila branch

(2) Mr. Birabarna Chakma, Pekkua, Kaptai

(3) Mr. Thuicha Prue Marma, Pekkua, Kaptai

The victims were brutally tortured at Island camp by the army. In addition, Mr. Birabarna Chakma was handed over to the police and a false case was lodged against them with Kaptai police station. In this connection, the PCJSS President of Kaptai upazila branch Mr. Thowai Aung Marma met Major Iyub, Deputy Commander of 14 EBR at Kaptai zone on 4/4/01 and demanded to release them. At the last, Mr. Uthowai Prue Marma, Member of Chitmaram union council and Organizing Secretary of PCJSS Kaptai upazila branch was released at 10.00 p.m. with serious injuries.

23 February 2001 : Frequent army checking in CHT Continuing

On 18/4/01 the army of Bagachari camp under Naniarchar upazila in Rangamati district stopped a passenger bus at Rangamati-Khagrachari road and started to check it. At that time, the Chairman of the CHT Regional Council Mr. Santu Larma reached there while going to Khagrachari from Rangamati and asked why they were checking the buses. The army could not show the due causes except timber one. In the meeting with brigade commander of Khagrachari brigade at Khagrachari circuit house on 19/4/01, Mr. Larma asked to brigade commander to stop the checking and the commander agreed to stop. But till to date, the checking is continuing as before.

23 April 2001 : Commander of Barkalak camp interfered social issues of Jumma people

On 23 April 2001 Subedar Ahmed of Barkalak Shahid Atiar camp in Barkal upazila issued an injuction that he would solve all the social disputes. It would not be accepted to him if any body (traditional institution) dealt it. Even no dispute on land could be solved without his consent. Accordingly, one Ms. Madhu Rani Chakma d/o Gada Ram Chakma of Barkalak village of Dumdumya Union under Barkal upazila was forcibly ordered by Subedar Ahmed to marry Mr. Kiranya Chakma s/o Kalajira Chakma of same village. As a result, Madhu Rani Chakma left the village for security of her life.

The camp commander even declared that he would deal all the social cases including land disputes. For instance, he interfered in a social case regarding marriage among two young Jumma man and woman and ordered to accept his judgement to the Headman and Karbari (traditional mouza head and village head of the indigenous Jumma people respectively) including said young man and woman. He has also been giving licence to use country-made gun to the people who were doing anti-social works. As a result, dacoity, kaidnapping, extortion of money etc have been increased in this area.

April 2001 : Supporters of the CHT Accord harassed by the army of Barkalak camp

Subedar Ahmed of Barkalak Shahid Atiar camp in Barkal upazila threatened the PCJSS and PCP members and supporters that if they work for PCJSS and PCP and CHT Accord as well, they would have to be faced severe consequents. Accordingly, as part of his anti-PCJSS/PCP activities, the camp commander committed harassmental activities against the PCJSS/PCP members and supporters, such as, torture, arrest, searching of their houses etc. For instance, on 27 April 2001 at mid-night he conducted an operation at Barkalak village. In this operation, he looked for the following villagers. But at that they were not their home. The camp commander falsely accused them that they had illegal firearms. The camp commander threatened the following villagers to lodge case against them in connection with keeping arms as they (victims) were working for PCJSS in support to democratic movement for implementation of CHT Accord.

Even on 14, 23, 24, 27 & 29 April 2001 the camp cammander threatened villagers not to work in favour of implementation of the CHT Accord.

4 May 2001 : CHTRC member halted by the army of No. 5 Rajasthali camp

On 4/5/01 the microbus of Mr. Mong Nue Ching Marma, member of the CHT Regional Council was stopped and tried to check by the army of 14 EBR of No. 5 Rajasthali camp under Rajasthali upazila in Rangamati district while going Rajasthali from Kaptai to attend the Khiang (an ethnic group of the Jumma people) Conference held at Kukya Para in Rajasthali. The CHTRC Chairman Mr. J B Larma alias Santu Larma inquired it while returning from the conference and the camp commander Warrant Officer Mr. Ibrahim admitted that they stopped the microbus for checking and there were 3 check posts within 15 kms road of Bangalhalia-Rajasthali. The Chairman asked them to stop the checking and informed it to their higher authority as it was inconsistant to the CHT Accord.

4 May 2001 : CHTRC member halted by the army of No. 5 Rajasthali camp

On 9/5/2001 the army of S. Ben army camp under Island army zone in Kapati under Rangamati district conducted an operation at Dhulyatali area under Kaptai upazila. In this operation, the army rounded the house of Mr. Swapan Chakma and arrested the following PCP workers. They were falsely accused in connection with extortion of money. The victims were:

(1) Mr. Dipankar Talukdar (16) s/o Smriti Bhushan Chakma

(2) Mr. Sunirmal Dewan (18) s/o Jyotimoy Dewan.

17 May 2001 : Three innocent Jumma youths arrested by the police in Rangamati

On 17/5/2001 at 3.00 a.m. police arrested three innocent Jumma youths in connection with the killing of an auto-rickshaw driver named Abul Kamal. It was notable that on 16/5/2001 the auto-rickshaw driver was shot by unidentified miscreants near the Bana Bihar area and died later at hospital. Md. Abdul Jalil Majumdar, president, Rangamati District Auto-rickshaw Driver Union filed a case (Case no. 8 of Rangamati upazila dated 16/5/01, section 302/34 BPC) against unidentified 3/4 Jumma youths with Rangamati police station. With this regard, the police arrested the following innocent Jumma youths from TTC road and Roy Bahadur road in Rangamati town at night. They were produced to the court and the court did not grant bail for them. Rather they were taken police remand for 3 days for interrogation. It was alleged that they were brutally tortured by the police during their custody. It is mentionable that as mentioned '3/4 Jumma youths' in the case, so the police could arrest any body at any moment. That is way the Jumma youths of Kalyanpur were passing with afraid of arrest. The arrested youths were:

1) Mr. Ranjit Chakma s/o Maratta Chakma of village TTC, Rangamati

2) Mr. Asha Chakma alias Tushar s/o Bichhu Basu Chakma of TTC, Rangamati

3) Mr. Ripan Chakma s/o Gopal Chandra Chakma of Raybahadur Road, T&T, Rangamati.

18 May 2001 : Communal attack by the Bengali setters in Boalkhari-Merung

On 18 May 2001 at 12.30 the Bengali settlers in cahoots with military and police pre-meditatively attacked three villages - Shanti-Laxmipur, Kalachan Mahajan Para and Hemabrata Karbari Para - of the returnee Jumma refugees of Chhota Merung Union under Dighinala upazila. On that day, the settlers organized a meeting in front of the office of the Dighinala Upazila Nirbahi Officer (UNO). At the end of meeting, they brought out a procession with anti-Jumma slogans along some 1-kilometer long road from the Dighinala UNO office to the Larma Square where Dighinala-Khagrachari and Dighinala-Merung roads meet each other. From there they went 5 kilometers south by trucks and attacked the Shanti-Laxmipur, then Kalachand Mahajanpara 6 kilometers further in the south and finally Hemabrata Karbaripara 9 kilometers further in the same direction. It should be noted that a group of army led by Major Momin of the Dighinala Cantonment and many police personnel led by Officer-in-Charge (OC) Sagir Ahmed Talukdar and Second Officer Mozammel of Dighinala police station were with the Bengali settlers while they were attacking the said villages.

b) It is mentionable that besides looting of and arson on houses, the settlers beat some people and took away many domestic animals such as cow, goat etc. from the Jummal people of the villages. According to a primary estimation, some Taka 5 (five) crore worth properties were damaged in the incident.

c) 5 women were seriously wounded in the incident. They were admitted in the Dighinala Sadar Hospital for treatment. They are:

1) Ms. Namita Chakma (20), d/o Jebendra Chakma of Village Shanti Laxmipur

2) Ms. Panchalika Chakma (22), d/o Saradhan Chakma of Village Shanti Laxmipur

3) Ms. Surobala Chakma (55), w/o Ittukya Chakma of Village Shanti Laxmipur

4) Ms. Suchitra Chakma (30), d/o Rajmohan Chakma of Village Gopal Memberpara

5) Ms. Sabitri Chakma, d/o Nagarchan Chakma of Village Shanti Laxmipur

d) The passport of the following Jumma students who were studying abroad were destroyed due to arson. The students were:

1) Master Shanti Lal Chakma s/o Satish Chandra Chakma, class VI, studying in Bodhicharya School, Calcutta, India. His Taka 28,000 and passport were looted.

2) Mr. Shwasata Priya Chakma s/o Bangshi Lal Chakma, studying B. A. Hon. (English), Delhi University, India. His passport and necessary documents including Taka 30,000 were burnt.

3) Ms. Remeli Chakma s/o.Bambakhula Chakma, class VI, studying in Bhodhicarya School, Calcutta, India. His passport, necessary documents and Taka 26,000 were looted.

4) Mr. Nagor Chan Chakma, s/o. Ramakasta Chakma. Studying in France. An amount of US$ 380 was burnt.

The reasons of the incident and its description

The Jumma people of Chhoto Merung Union, which is situated at the southern part of Dighinala upazila in Khagrachari district, were uprooted from their villages in 1986-1991 and forced to take shelter in the refugee camps in Indian State of Tripura due to communal riots and mass-killings. They were repatriated to CHT under the 16 and 20-point Package Agreements reached between the delegation of the government of Bangladesh and the Jumma refugee leaders and under the CHT Accord of 1997. Most of them could not go back to their homesteads and villages due to lack of security and the presence of the Bengali Muslim settlers. However, the refugees affected by the said incident managed to go back to their villages. The settlers were continuously trying to uproot them and to illegally seize their homesteads and villages. That is why they had been resorting to various impair ways such as riot, looting, arson, harassment, framing cases etc. against the refugees of the said villages in various pretexts.

On 14 May 2001 Osman Gani, the VDP (Village Defense Party) commander in post stationed near the Chamrachari Army Camp of Chhoto Merung under Dighinala upazila was attacked and shot dead by a few unknown terrorists while he was on his way to his camp with the salary withdrawn for his men from Sonali Bank, Dighinala Sadar branch.

On 15 May 2001 centered round the incident, the VDPs and settlers of the areas brought out procession in Dighinala. They threatened the Jumma people shouting slogans like "hatyar badale hatya" (killing for killing).

On 17 May 2001 a secret meeting was held between the military authority and the settlers' leaders in the Dighinala cantonment. The said incident was committed on the basis of the decision taken in this meeting.

On 18 May 2001 at 10.30 the Bengali settlers organized a meeting in front of the office of the Dighinala Upazilla Nirbahi Officer (UNO). At the end of meeting, they brought out a procession with anti-Jumma slogans along some 1-kilometer long road from the Dighinala UNO office to the Larma Square where Dighinala-Khagrachari and Dighinala-Merung roads meet each other. From there they went 5 kilometers south by trucks and attacked the Shanti-Laxmipur, then Kalachand Mahajanpara 6 kilometers further in the south and finally Hemabrata Karbaripara 9 kilometers further in the same direction. It should be noted that a group of army led by Major Momin of the Dighiunala Cantonment and many police personnel led by Officer-in-Charge (OC) Sagir Ahmed Talukdar and Second Officer Mozammel of Dighinala police station were with the settlers while they were attacking the said villages.

The indigenous Jumma people of Shanti-Lakxmipur village alleged that on arriving of the settlers, police and military at the Shanti-Lakxmipur village, a VDP person snatched away a rifle from a police and fired several rounds of bullet aimlessly. Then the settlers started looting and setting fire on the houses of the Jumma people. The OC and Second Officer of Dighinala police station were watching the activities of the settlers as a passive onlooker. A group of young Jumma people approached the OC and the Second officer and requested them to stop the settlers from carrying out their activities. Consequently, the OC did nothing except playing his referee.

Similarly, the settlers went away to their homes after looting and setting fire on the houses of Jumma people of other two villages mentioned above. However, they desperately tried to find out and kill Hemabrata Karbari and other four Jumma refugees who are continuing land related cases against some settlers in court.

Later, the Jumma people of Shanti Laxmipur came forward to resist the attack of the settlers. The military blocked, charged with sticks and dispersed some Jumma people of nearby Kabakhali and Pablakhali areas who wanted to come in the spot for rescue operation of the people injured.

A meeting chaired by Mr. Jatindra Lal Tripura, Chairman, Khagrachari Hill District Council was held on 18 May 2001 at the Dighinala Upazilla Sadar with the local leaders at the presence of Mr. Sudhasindhu Khisa, member of CHT Regional Council, Mr. Raktoutpal Tripura, member of CHT Regional Council, Mr. Ashraful Maqbul, Deputy Commissioner, Khagrachari Hill District, Additional Police Super of Khagrachari Hill District, Additional Divisional Commissioner of Chittagong, DIGP od Chittagong Range. In the meeting, it was expressed that there was a need for maintaining peace and harmony of the area and for immediate supply of cloths of daily use, food and utensils to the affected tribal people. It was also decided to tale immediate and necessary steps through Khagrachari HDC, Red Crescent and Khagrachari DC to this effect. However, the Chairman of Khagrachari Hill Districts Council apprised the meeting regarding lack of necessary fund in the Council to provide such amount of assistance the affected people.

The amount of damage

(a) In this incident, 42 houses of Jumma people were burnt down and looted. Among them, some owners of the houses at Shanti Laxmipur were are as follows:

21 May 2001 : Innocent Jumma cowherd arrested by the police in Longadu

On 21 May 2001 the police of Longadu upazila arrested the following innocent Jumma cowherd from Rangapanichara area under Longadu upazila in connection with the kidnapping of a Bengali settler named Rabiul. Mr. Rabiul was kidnapped by unidentified miscreants on 16 May 2001 at Longadu area. Kamal Bikash was compelled to give fingerprint (as he was illiterate) in a white paper where the police wrote later that he involved with the kidnapping. He was produced court in Rangamati on 23/5/2001 and the court did grant his bail. The victim was:

22 May 2001 : Three Jumma youths arrested by the police in Rangamati

On 22/5/2001 the police of Katowali police station of Rangamati district arrested following three innocent Jumma youths from Devasish Nagar area as a part of so-called operation against the terrorists after the killing of auto-rickshaw driver Mr. Abul Kamal. The arrested youths were:

1) Mr. Runel Chakma (18) of village Kalyanpur in Rangamati;

2) Mr. Subal Talukdar (19) s/o Sumati Ranjan Talukdar of village Kalyanpur in Rangamati

3) Mr. Mithu Chakma alias Chikka of village Devashis Nagar in Rangamati.

All were candidate for HSC examination. Mr. Runel was released at night. He had reached home from Dhaka just three days before. The Bengali settlers filed a false case against Subal Talukdar in 1998 during the attack upon the Jumma people at College Gate, Kalyanpur and Devasish Nagar in Ranagamti town by them. Mr. Subal Talukdar and Mr. Mithu Chakma were produced to the court and the court did not grant their bail.

22 May 2001 : Three Jumma women raped by the army in Matiranga

On 22 May 2001 at 1.00 a.m. a group of army from Durgabari camp under Guimara brigade conducted an operation at Barachandra Karbari Para in Matiranga upazila under Khagrachari district in the name of searching terrorists. During the operation, the army personnel harassed and tortured the Jumma villagers indiscriminately and at a stage, they raped the following three Jumma women of Barachandra Karbari Para. The victimized women were admitted with serious condition at Khagrachari General hospital. Besides, one-year-old child of Pubali Tripura and an aged Jumma were also admitted at same hospital with injuries. The raped women were:

1) Ms. Pubali Tripura (23) w/o Bataray Tripura.

2) Ms. Karandi Tripura (20) d/o Hari Mohan Tripura

3) Ms. Sanita Tripura (16).

Besides, the army arrested a Jumma youth from Barachandra Karbari Para to conceal their misdeeds and legalize their operation. He was falsely accused in connection with terrorist activities. The arrested youth was:

1) Mr. Jipsi Ranjan Tripura.

21 May 2001 : Massive communal attack on Jumma people in Ramgarh

On 25 June 2001 from 12.00 noon to 4.00 p.m. the Bengali settlers attacked on the Jumma-inhabited villages, namely, the Bulturam Tila, Jagannath Para, Sukendray Para, Chowdhury Para, South Garjantali etc under Ramgarh Municipality in the Khagrachari Hill District. 126 houses of the Jumma people were burnt into ashes and 118 houses were looted and destryed in the attack. The several Jumma people were injured by the attack of the settlers while they tried of resist the attack.

The discription of the incident:

On 23 June 2001 a truck driver named Atar Ali was first abducted by a gang of allegedly Jumma terrorists from the area of Ramgarh Upazila and he was shot dead later on. On 25 June 2001 to carry forward the matter an agitated meeting and procession was organized under the banner of "Bangali Krishak-Shramik Kalyan Parishad" by the leadership of Rejaul Karim Helal & Ualiullah and the settlers created communal excitement in the Ramgarh area. At the end of the gathering at Ramgarh Municipal Auditorium, the Bengali settlers hold a fighting procession in the public road of Ramgarh, demanding 10 chartered point of demands. The UNO of Ramgarh upazila and the OC of the Ramgarh police station Mr. Kanchan Ali Mahmood were present with the procession. The agitated Bengali settlers created fear bursting chocolate bomb and cocktail while the procession of the settlers arrived at Master Para. After that, the settlers falsely announced through mikes from the two local mosques that the terrorists of the Hill Students Council have attacked on the procession of the Bangali Krishak-Sramik Kalyan Parishad and killed three Bengalis including a police officer. Therefore, "you (settlers) all come forward to resist the Jummas where ever you are." Within a moment, a big excitement was created and the settlers with sharp kirich, digger, spares and firearms attack on the villages of the Jumma people.

At first the Bengali settlers broke and looted the offices of the PCJSS and the Pahari Chatra Parishad (PCP). However, the settlers abstained from arsoning, as there were houses of the Bangalis surrounding the offices.

The Bengali settlers burnt and looted the selected all tribal houses. The settlers entered into a small pedestrian way, away from the Ramgarh main road and burnt and looted all selected Jumma houses. There after the Bengali settlers burnt Baltu Ram Tila, Jagannath Para, Dhebar Par, Sukendrai Para, Choudhury Para, Master Para and South Garjantali etc one by one.

About 150-200 attackers divided into 6-7 groups pre-planned to burn by dropping Kerosene in the Jumma houses. The Bengali settlers threw stones, cocktail to create fear among the Jumma people and burnt the houses. During that time, the Jumma people were busy in the farmland, offices and in business.

The incident started at 12.30 noon and the whole scenario continued for four hours. All the time of incident the UNO of Ramgarh upazila and the police forces on duty were like a silent audience. It was alleged that there were some police personal helped the settlers who did not have match sticks to burn the houses.

The houses of Mr. Thomrasing Marma, the members of the CHT Regional Council; Mr. Appa Choi Choudhory, Headman of 235 Nakappa Mouza; Mr. Subal Tripura, Correspondent of a national daily; Mr. Bikram Kishore Tripura, the student leader were completely burnt to ashes in this brutal attack. At the time of arsoning the house of Thomrasing Marma the UNO of Ramgarh and the OC were remained silent inspite of their presence in the spot. Not only that the Deputy Commissioner of Khagrachari district Mr. Asraful Makbul and Superrintendent of Police Mr. Mozammell Hossain were also present in Ramgarh during the incident. They abstained themselves from taking any step tactfully during the incident. Besides, the BDR Zone commander Lt. Colonel Abu Taher said Bengali settlers that they were given two hours time to do whatever they desired.

Those women who were trying to extinguish the fire during the incident were beaten and driven out by the Bengali settlers. Many of them tried to take shelter in the BDR out post but the BDR personnel refused to give them shelter. Consequently more than hundreds Jumma including women and children compelled to cross the Border and took shelter in India. It is mentionable that the majorities affected were the returnee refugees repatriated after the CHT Accord.

It is further mentionable that the Bengalis who tried to save and protect the houses of the Jumma people from fire were harassed. Even they were called the "broker" of the Shanti Bahini. The local Madrasa teacher Abdul Malik in this connection said that he was called the broker of the Shanti Bahini and driven out while he was trying to save and protect the houses of the Jumma people. Even the Ananda Buddha Vihar of Master Para, Mangla Choudhory Memorial Library of Choudhory Para and the office of the Tripura Unemployment Youths Welfare Association were also not exempted from arsoning and looting. Ratan Boisnab, the President of the Tripura Unemployment Youths Welfare Association said that their office was broken and looted by the Bengali settlers instead of arsoning as there were shops of the Bengalis around their office. They burnt the national flag and the poster of 21 February and the Independence Day. In this incident a total number of 110 houses which consisted of 18 half wall house, 71 teen shed house, 21 thatch houses were burnt to ashes. 117 houses were broken and looted. More than 2000 Jumma people were affected. The total amount of the damages was about to two crores approximately.

The purpose of the incident

The main purpose of this incident was to occupy the land of the Jumma people. The main strategy of this incident was to push the Jumma people to India creating fear among the Jumma people. The communal attack on the Jumma people on 18 May 2001 in Dighinala and arsoning, looting, raping of the Jumma women by the army personnel on 21 May 2001 in Matiranga and arsoning to the Jumma houses at Mahalchari on 29 April 2001 were nothing else except the systematic activities of the above purpose.

It is not the real fact though the incident seems created to carry forward the killing mater of the Truck driver, Atar Ali. The Bengali settlers already took the plan of communal riot with the help of any plea. To serve the purpose a preparation of procession gathering was organized under the banner of Bengali Krishak-Sramik Kalyan Samity long days before. For the above purpose truck loaded settlers had been brought from Khagrachari Sadar, Matiranga, Juliapara etc to Ramgarh upazila headquarter.

From a reliable source it was informed that a few days ago the BDR and the army officers, BNP leader Abdul Wadud Bhuiyan, Awami League leader Waliullaha and others communal settler leaders held a secret meeting. It was informed that they had made blue sketch to run the anti-peace activities, creating the communal fear just before the forth coming parliamentary election. The communal attack on 18 May 2001 in Dighinala and on 25 June 2001 in Ramgarh were conducted according to their systematic planning.

Besides, the police authority arrested 6 innocent Jummas involving them in the Atar Ali murder case instead of taking any steps against Bengali settlers involved with this communal attack. Not only that the police authority refused to accept the case while Apuchi Choudury, the headman of 235 Nakappa Mouza went to police station to file a case.

The most surprising matter was that the incident did not take place in remote area but in the heart centre of Ramgarh Municipal and Asraful Makbul, Deputy Commissioner of Khagrachari and Mozammel Hossain, Police Super of Khagrachari district were present in Ramgarh sadar during the incident.

It was known that one Bengali truck driver involved with the Atar Ali murder case. A few days before owner of the truck expelled this truck driver and appointed Atar Ali in place of the expelled driver. Many local people alleged that the driver who was expelled killed Atar Ali with anger and reaction. It was suspected that the leaders of the Bangali Krishak-Shamik Kalyan Parishad might be involved with Atar Ali murder case to create communal tension.

The Jumma people alleged that just to cover up their crime and injustice the settlers organized a gathering for 10-point charter of demands to create communal riot.

The reaction

In an immediate reaction, the PCJSS mentioned the communal attack as pre-planned incident. It was also mentioned that the incident was not an exceptional one that usually conducted communal attack. The PCJSS expressed that these types of serious political situations would come to an end through the proper and speedy implementation of the CHT Accord. Mr. Kalpa Ranjan Chakma, the minister of CHT Affairs was also in harmony with the PCJSS saying that the incident was "A pre-planed incident". The anti-accord terrorists had done the work and some dishonest people of the administration helped in it.

The PCJSS called a full day "Hartal" on 27 June 2001 in three Hill districts. The PCJSS demanded for punishment to the persons involved with the incident and claimed proper compensation for the rehabilitation of the affected people. In a statement made by 11 left democratic alliances it was alleged that the communal activities in CHT were due to non-implementation of the CHT accord.

The victimized Jumma people submit a Memorandum to the Prime Minister through Mr. Kalpa Ranjan Chakma on the following demands:

1. The immediate arrest and exemplary punishment to the local leaders and Helal, the leader of the Bangali Krishak Sramik Kalyan Parishad, to be executed.

2. The local administrative officers are to be punished on the basis of inquiry report.

3. A total sum of Tk. 2,00,000/- to be given to every effected family and the ration facilities to be ensured for three years.

4. The security arrangement to be ensured for their own respective areas.

5. A judicial inquiry to be conducted with the visit of Home Minister and CHT affairs Minister.

6. The appropriate step to be ensured so that this type of unwanted incident does not take place repeatedly in future.

The initiative of the government

On 27 June 2001 Mr. Kalpa Ranjan Chakma, Minister of CHT Affairs and Mr. Jyotirindra Bodhipriya Larma, Chairman of the CHT Regional Council visited the spot and both delivered their lectures in a public meeting. Mr. Jyotindra Lal Tripura, Chairman of Khagrachari District Council, the member of the CHT Regional Council, D.C. & S.P of the Khagrachari district were present during the time.

In the meeting, the Chairman of the CHT Regional Council alleged that the attack on the"Jummas" by the Bengalee settlers in Ramgarh was not a separate incident. The similar incidents already took place in Dighinala and Matiranga very minutely by the settlers.

He said the incident in Ramgarh in the presence of army & police was very "Regretful" as the similar incidents had been taking place one after another due to non-implementation of the CHT accord. The temporary military camps had not been withdrawn although it was clearly mentioned in the CHT Accord. The military administration was still existing in CHT. These types of attacks of the Muslim fundamentalists by the instigation of the military were everywhere in CHT. Therefore, before resigning from the post of "Prime Ministership", the Prime Minister has to take appropriate and reasonable measures about the CHT Accord.

In an appeal to the Jumma people Mr. Larma said that the Jumma people had to ensure the own existence in the motherlands, the ruler intended to destroy the existence of the Jumma people. The Jumma people had to stay here in the CHT. They had to ensure their existence and identity in this place. One had to remember that the struggle for own existence had yet not been come to an end. Jumma people had to face struggle again if it was required by the demand of time. He also said that the strong measure had to be taken against the persons involved in Ramgarh incident. In addition, he demanded that all temporary military camps had to be withdrawn from the CHT as per the clauses of the CHT Accord without any further delay.

The Minister Kalpa Ranjan Chakma declared the grant of 75 metric tones of food grain to the affected Jumma people in the meeting on 27/6/01. In the next day, he distributed Laungi, shirt and sharees among the affected people. Besides, a grant of Taka 15 lacs from the Relief Fund of the Prime Minister was also declared to the affected people. It was declared that for each burn-affected family TK. 10,000, for each other affected family TK. 5,000, and for each student TK 3,000 to purchase school's materials as compensation.

On 26 June the sheltered Jumma people in India were taken back through a flag meeting between the authorities of the BDR and BSF. On 28 June 16 Bengali settlers were arrested concerning the terrorist activities and 6 Jummas arrested in false case were released. Kanchan Ali Mahmmud, the OC of Ramgarh police station was closed.

The arrest of 6 Jumma youths

On 24/6/2001, the police-BDR personnel arrested the following six Jumma youths in connection with the truck driver, Atar Ali murder case. They were released by the pressure from the masses after the attack on Jummas and their houses were burnt down to ashes on 25/6/2001 by the settlers later. It was learnt that the arrested persons were beaten during the police remand. The arrested persons were the following:

Perpetrators of the incident

On 26/6/2001 Nihla Aung Karbari s/o Ruimrochai Marma of village Master Para under Ramgarh lodged a case against the following perpetrators with Ramgarh police station. However, no body was arrested so far. The main perpetrators of the incidents are as follows:

27 June 2001 : Returnee PCJSS member arrested by the army in Alikadam

On 27 June 2001 a returnee PCJSS member named Mr. Jagadish Tripura alias Suren (29) s/o Satish Chandra Tripura of Alikadam under Bandarban district was caught and then taken to the Alikadam Cantonment by the army of Alikadam Cantonment in Bandarban district. He was harassed and ordered not to form Youth Association in his village. It is notable that the PCJSS formed Youth Association in every village in CHT. Before taking him in the Cantonment the army rounded up his house and destroyed valuables of his house.

19 July 2001 : Two Jumma labourers arrested by the police in Rangamati

On 19 July 2001 the police of Katowali police station in Rangamati district arrested Mr. Dhanamoni Chakma (32) s/o Chikanya Chakma and Mr. Montu Chakma (22) s/o Hulamoni Chakma from Hatchery Para under Rangamati Municipality. They were daily labors and arrested with a false stealing case lodged in 1995.

15 August 2001 : Jumma houses searched by the army in Baghaichari

On 15 August 2001 at 1.30 p.m. a group of army from Nangalmara camp under Baghaichari upazila in Rangamati district conducted an operation at Tularam Karbari Para in Baghaichari upazla. The army searched the houses of following persons and destroyed some valuables of the houses.

(1) Mr. Karunamoy Chakma (35) s/o Bizudhan Chakma

(2) Mr. Jnana Ranjan Chakma (50) s/o Kamalya Chakma

(3) Mr. Kamalya Chakma (70) s/o Bidyaraj Chakma

(4) Mr. Jnana Bikash Chakma (35) s/o Hiranya Chakma

(5) Mr. Bipin Chandra Chakma (35) s/o Raj Mohan Chakma.

18 August 2001 : Jumma houses searched by the army in Baghaichari

On 18/8/2001 a group of army of 37 Bengal from Baghaichari camp under Baghaichari upazila along with Forest Department staff of Rangamati district conducted an operation at Balughat area in Baghaichari. In this operation, the army searched houses and destryed some valuables of the houses. During searching of Amulyadhan Chakma's house, an army tried to rape Amulyadhan Chakma's wife Ms. Badini Chakma. At that time, she was alone in the house. But she could escape narrowly. The army searched the following houses:

(1) Mr. Manu Ranjan Chakma

(2) Mr. Jnana Ranjan Chakma

(3) Mr. Amulyadhan Chakma

(4) Mr. Trishankar Chakma.

28 August 2001 : Jumma student arrested in Rangamati

On 28/8/2001 a Jumma college student (name was not available) was arrested from College gate area in Rangamati district. He was accused with a case that was withdrawn by the Case Withdrawal Committee of Rangamati district according to the CHT Accord. He was under detention.

2 September 2001 : Adolescent Jumma student arrested by the police in Rangamati

On 2/9/2001 at 1.00 a.m. police from Kotowali police station of Rangamati district conducted an operation at TTC road in Rangamati town. During the operation, an innocent student of Rangamati Technical Training Centre (TTC) named Mr. Nabarun Chakma (14) s/o Binoy Kumar Chakma was arrested from TTC road in Rangamati while he was speeling at his home. Next day he was produced to the court and sent to joil custody. After a week the court granted bail to him as the police failed to show any case against him. But his poor father (autorickshaw driver) had to spent more than Taka 20,000 for legal fighting to get bail from the court.

9 September 2001 : Adolescent Jumma girl was tried to kidnap by a army in Jurachari

On 9/9/2001 Subedar Ayub from Rest Hat Fakirachara camp of 40 Bengal under Kaptai brigade in Rangamati district tried to kidnap an adolescent Jumma girl named Miss Hasina Chakma (13) d/o Basu Chakma of village Fakirachara of Moidong mouza under Jurachari upazila in Rangamati district from Panighat area while she was going to bring water from river. The villagers led by Dilip Chakma, member of Moidong Union Council rushed there while Miss Hasina Chakma was shouting and rescued her from nearby area of camp. The villagers complained againt Subedar Ayub to the camp commander. But no action was taken against the culprit.

27 October 2001 : Jumma devotees harassed by the army in Ghagra bazar

On 27/10/2001 the army of 50 Bengal from Champatali camp of Ghagra in Rangamati district harassed the following devout Jummas while raising fund for Buddhist holy festival 'Prabarana Purnima' of Rajbana Bihara of Rangamati and Ghagra Swadharma Bouddha Bihara of Ghagra bazar. Army personnel seized the coupon books and leaflets from them. The army tried to take them to camp but at the last they released Jumma devotees as the mass people protest against it. The victims were:

(1) Mr. Krishna Ratan Chakma (23) s/o Nilongdhan Chakma of village Champatali under Kaukhali.

(2) Mr. Titul Chakma (24) s/o Mogya Chakma of same village.

(3) Mr. Dhana Moni Chakma (23) s/o Biraj Mohan Chakma of same village.

8 November 2001 : PCJSS member arrested by the army in Alikadam

On 8/11/2001 the army of Choikkhyong army camp under Alikadam cantonment in Bandarban district arrested the following PCJSS members while raising fund with coupon for observation of 18th death anniversary of founder leader of PCJSS and and champion of national awakening in CHT Manabendra Narayan Larma. They were handed over to Alikadam police station after heavily physical torture by army and then transferred to Bandarban district jail. They were falsely accused in connection of extortion of money. They were granted bail after a couple of months. The victims were:

(1) Mr. Dilip Tripura (32) of village Choikkhyong in Alikadam upazila

(2) Mr. Chau Prue Marma (35) of village Choikkhyong

22 November 2001 : Two Jumma youths harassed by the BDR at Harina

On 22/11/2001 the following Jumma youths at Harina Launch Ghat under Barkal upazila in Rangamati district were harassed by BDR of 10 Battalion led by Adjutant Saimum of Chota Harina camp. The BDR caught them and interrogated them for 3 hours. The BDR threatened them for severe consequence if they disclosed about harassment commited on them. The victims were:

(1) Mr. Ratan Kumar Chakma, president of Barkal upazila branch of PCP

(2) Mr. Amar Kumar Chakma, president of Barkal upazila branch of Juba Samiti.

2 December 2001 : Innocent Jumma villagers arrested and tortured by the army in Panachari

On 2/12/2001 the army of Jarnatilla camp arrested an innocent Jumma passenger of jeep named Mr. Braja Kishore Tripura s/o Shashiram Tripura of village Gouranga Para under Matiranga upazila in Khagrachari district. On the other, Mr. Prartana Kumar Tripura s/o Joyanmoni Tripura was also arrested while returning home from Panchar bazar. It was notable that a passenger jeep was looted at Jarnatilla of Tabulchari-Panchari road in Khagrachari district. The Jummas mentioned above were arrested in connection with this looting. But the villagers and relatives of the victims told that during the looting, Prartana Kumar was at Panchari bazar along with his 10 years old daughter.

The army handed over them to Panchari police station after heavily beating and harassing. The army from Jarnatilla camp also conducted operation at Maratilla village in connection with the dacoity. Mr. Aungaj Marma s/o Kyalau Marma and Mr. Deba Ranjan Tripura s/o Saday Ranjan Tripura were also brutally beaten by the army during the operation. The army threatened that all the villagers would be tortured if they could not hand over the culprits of the incident. On the other, three Karbaris (village head) were harassed while they went to police station for inquiring the incident and to see the arrested persons. The villagers of the area submitted a memorandum to the Deputy Commissioner of Khagrachari district demanding to release the innocent Jummas and to maintaining law and order. But the arrested persons were sent to joil custody.
